On Jan. 22, 2025, President Donald Trump issued a new executive order, revoking Executive Order 11246 — which imposes federal nondiscrimination and affirmative action employment obligations on covered federal government contractors.

The new executive order does a good bit more, directing preparation of a report regarding recommendations for “enforcing federal civil-rights laws and taking other appropriate measures to encourage the private sector to end illegal discrimination and preferences, including DEI.”

A panel of affirmative action and government contracting team members from McGuireWoods provide an overview of the new executive order and related legal implications and risks for all.

Topics

  • The scope of the new executive order
  • The revocation of Executive Order 11246
  • The impact on protected veteran and disabled individual affirmative action
  • The impact on pending and future OFCCP audits
