Alex Madrid Pens Law360 Article on Uptick in Deceptive Pricing Class Actions

In a Dec. 11 Law360 article titled “Deceptive Pricing Class Actions Pose Risk For Retailers,” McGuireWoods Pittsburgh associate Alexander Madrid discusses the deceptive use of “price anchoring,” where merchants compare the advertised “sale” prices for their products to the “original” prices. Plaintiffs in related suits claim the original prices are not the true prices of products, and accuse merchants of engaging in misrepresentation and false advertising. Alex notes the recent increase in such class-action complaints, most of them in California, and recommends that retailers be prepared to produce evidence that their products did in fact sell at their advertised original prices.
