The New York Law Journal featured an article by New York partner Noreen Kelly and Washington, D.C., associate Casselle Smith on the need to protect privileged client information while maximizing cooperation credit from federal enforcement agencies.
The Nov. 21 article, “Privilege Protection in an Era of Cooperation,” examines the challenges corporate defense lawyers face in balancing the need for disclosure with the obligation to protect privileged information from internal investigations. The issue has taken on greater urgency after publication of the Justice Department’s Yates Memo, which called for individual accountability in civil and criminal enforcement matters.
Kelly is managing partner of the firm’s New York office and leads the financial institutions industry team. Smith is a member of the firm’s Government Investigations and White Collar Litigation Department.
