Law360 quoted McGuireWoods partner Adam Simons in a Dec. 21, 2020, story on employers’ reimbursement responsibilities when it comes to telecommuting.
Despite how common remote work has become during the pandemic, the rules surrounding employers’ reimbursement responsibilities vary by state and by company, which has made the structure difficult for businesses and workers to navigate.
Plaintiffs’ lawyers will find ways to challenge reimbursement limitations, Simons said, but the larger issue will be with “employers who have not [previously] had work-from-home or telework arrangements.”
