Sam is a versatile litigator, adeptly representing individuals and corporations alike in state and federal court proceedings, and before executive agency tribunals. From providing guidance on litigation avoidance and resolving pre-litigation disputes to navigating the complexities of discovery and trial, Sam offers comprehensive counsel at every stage of the legal process. With a focus on both the government contracting space and the commercial sector, Sam brings a diverse perspective to his practice. He has successfully represented clients across various industries, offering strategic guidance tailored to their unique needs and objectives.
Having represented a number of government contractors of various sizes, Sam has a beneficial perspective on the legal and regulatory issues unique to the government contracting sector. He has demonstrated prowess in navigating through legal issues and avoiding legal exposure through prophylactic measures. Sam has also represented medical professionals and high-level government personnel in investigations before regulatory boards.
Sam’s investigations practice includes crisis management including navigating clients through fast moving events that contain legal and regulatory components and avoiding potential legal exposure. Sam has led teams in conducting internal investigations in response to grand jury subpoenas and other regulatory inquiries.
In addition to his litigation expertise, Sam plays a pivotal role in counseling small companies through pivotal stages of growth, including formation, ownership transitions, and navigating various growth phases.
Early in his career, prior to joining McGuireWoods, Sam practiced in the criminal defense space where he honed his investigation and cross-examination skills in aiding and guiding his clients through the exacting legal process.
Originally from Denver, Colorado, Sam maintains a strong connection to his roots and enjoys supporting Colorado sports teams in his leisure time when he’s not diligently serving his clients.
Experience
- Won a four-day bench trial for a deregulated energy market electric supplier against an energy broker in a breach of contract and unjust enrichment dispute.
- Settled a case for one of the largest fully regulated utility companies in the United States by convincing the trial judge to rule on a novel issue that led to prohibiting testimony from three expert witnesses on behalf of the defendant developer.
- Successfully represented established tech companies and government contractors in litigation arising out of breach of contract, trade secrets violations, and violations of non-solicitation provisions.
- Represented and counseled management in separation and litigation challenging personnel decisions.
- Counseled individuals and entities subject to investigations including responding to prosecutorial requests for information from federal and state agencies, subpoenas, and defending privilege assertions.
- Represented corporation in dispute with former shareholder who claimed ownership based on outstanding share certificate – won favorable verdict and Court ordered share certificate returned.
- Represented non-profit organization and individual in litigation against fraudulent healthcare provider who was practicing without a license and their insurer.
- Represented parties in insurance coverage disputes including duty to defend and indemnify.
- Represented company against former CEO for fraud, state RICO, and trade secrets violations when he misappropriated company assets to form new company.
- Advised companies regarding ownership changes and negotiated terms of repurchase.
- Represented and counseled senior federal officials, law enforcement agents, and federal employees through personnel investigations, conduct and performance claims, USERRA-based claims, internal investigations, security clearance issues, Fitness for Duty issues, and OIG investigations before the MSPB, EEOC, federal and state administrative agencies, district courts, and appellate courts.
- Represented physicians in matters regarding licensing issues, investigations, and conduct hearings before the Board of Medicine for the District of Columbia and negotiated favorable settlement terms.
